MEMBERSHIP AGREEMENT
1. Parties
a) The company operating the website www.babazadebaklava.com is ALLA ZENGİN TARIM ENDÜSTRİ ÜRETİM TURİZM YATIRIM SANAYİ VE DIŞ TİCARET ANONİM ŞİRKETİ, located at Yakuplu Mahallesi 30. Sokak No:21/6 Beylikdüzü - Istanbul (hereinafter referred to as “Babazade”).
b) The internet user who becomes a member of www.babazadebaklava.com (hereinafter referred to as the “Member”).
2. Subject of the Agreement
This agreement sets forth the terms and conditions under which the Member may benefit from the services provided by Babazade through the website www.babazadebaklava.com.
3. Rights and Obligations of the Parties
3.1. The Member declares and undertakes that the personal and other information provided while registering to www.babazadebaklava.com is accurate and truthful, and that the Member shall immediately and fully compensate for all damages incurred by Babazade due to the falsity of such information.
3.2. The Member may not share the password provided by Babazade with third parties or institutions. The Member is solely responsible for the use of the password. Babazade reserves all rights to claim compensation for any unauthorized use.
3.3. The Member agrees to comply with all legal regulations while using the site and acknowledges responsibility for any legal or criminal consequences that may arise from violations.
3.4. The Member shall not use the website www.babazadebaklava.com in any way that is against public order, general morality, violates third-party rights, or is unlawful. The Member also agrees not to engage in activities that hinder or prevent others from using the services (such as spam, viruses, Trojan horses, etc.).
3.5. The opinions and comments expressed by Members on the website are solely their personal views and do not reflect those of Babazade. Babazade shall not be held liable for any damages resulting from such opinions.
3.6. Babazade is not responsible for unauthorized access to Member data or for any damages to Member software or data. The Member accepts not to hold Babazade liable for any such damages.
3.7. The Member agrees not to access or use the data or software of other users without permission. Otherwise, the Member assumes full legal and criminal liability.
3.8. If the Member violates any clause of this agreement, the Member is personally responsible for the consequences. Babazade reserves the right to claim compensation and initiate legal proceedings.
3.9. Babazade reserves the right to unilaterally delete a Member’s account and related files and data at any time. The Member accepts this in advance.
3.10. All software and design of www.babazadebaklava.com are owned by Babazade and protected by copyright and intellectual property laws. Members may not use or alter them without permission.
3.11. For the purpose of improving the site, Babazade may collect data such as IP address, service provider name, access time, pages visited, and referring site.
3.12. Babazade may disclose Member information when required by law or in good faith belief that such disclosure is necessary to protect its rights or comply with legal processes.
3.13. While Babazade takes measures against malicious software, final responsibility for protection lies with the Member. The Member agrees to bear any damages arising from site access.
3.14. Babazade reserves the right to modify or terminate site content or services and delete user information at any time.
3.15. Babazade may change, update, or terminate this agreement at any time without prior notice. Updated provisions become effective upon publication.
3.16. Parties agree that all electronic records of Babazade shall be deemed conclusive evidence as per Article 287 of the Code of Civil Procedure.
3.17. By accepting this agreement, the Member consents to receive informational emails and SMS messages from Babazade.
4. Termination of the Agreement
This agreement remains valid until the Member cancels their membership or Babazade terminates it. Babazade may unilaterally terminate the agreement if the Member violates any clause.
5. Dispute Resolution
Any disputes arising from this agreement shall be subject to the jurisdiction of Istanbul Courts and Enforcement Offices.
6. Enforcement
The Member’s registration signifies that they have read, understood, and accepted all terms of this agreement. This agreement becomes mutually effective at the moment of membership registration.
