DISTANCE SALES AGREEMENT


ARTICLE 1 – SUBJECT


This agreement determines the rights and obligations of the parties in accordance with the Law on the Protection of Consumers No. 4077, the Regulation on Distance Contracts, and the Turkish Commercial Code regarding the sale and delivery of the product whose qualities and sale price are specified below, sold by ALLA ZENGİN TARIM ENDÜSTRİ ÜRETİM TURİZM YATIRIM SANAYİ VE DIŞ TİCARET A.Ş. (hereinafter referred to as “Babazade”), located at Yakuplu Mahallesi 30. Sokak No: 21/6 Beylikdüzü, Istanbul, through its website www.babazadebaklava.com.

ARTICLE 5 – GENERAL PROVISIONS


5.1. The Buyer acknowledges having read and confirmed electronically the essential characteristics of the product, its price, payment method, and delivery information listed in Article 4.


5.2. The product shall be delivered to the Buyer or to a third party designated by the Buyer within the period stated in the pre-information form, depending on the Buyer’s location, and no later than 30 days from the order date.


5.3. If the product is to be delivered to someone other than the Buyer, the Seller cannot be held responsible if the recipient refuses delivery.


5.4. The Seller does not guarantee delivery itself, but only ensures that the product is shipped in proper condition as described. Delivery liability lies with the courier company. Any claims regarding replacement or refund due to delivery issues not attributable to the Seller are invalid.


5.5. The Seller is deemed released from the delivery obligation if payment is not received or is canceled by the bank.


5.6. In case of fraudulent or unauthorized use of the Buyer’s credit card after product delivery, the Seller retains the right to claim the unpaid amount through legal channels.


5.7. In cases of force majeure (such as extreme weather or transportation disruption), the Seller must notify the Buyer. The Buyer may cancel the order or choose to delay delivery. If canceled, the paid amount will be refunded within 10 days.


5.8. In international orders, the Buyer is responsible for taxes and customs duties required by their country’s authorities.


5.9. This contract becomes valid once approved and accepted by the Buyer electronically.


ARTICLE 6 – RIGHT OF WITHDRAWAL AND RETURNS


In accordance with the Turkish Commercial Code, the right of withdrawal does not apply to food, beverages, and other perishable daily goods. Returns are only accepted for defective products, and only if the product is unused, unopened, and in its original packaging.


Products are manufactured in compliance with the Turkish Food Codex and Turkish Standards Institute. If a product is defective or the packaging is damaged (torn, opened, or crushed during shipping), the customer must email a product photo to info@babazadebaklava.com.


Damaged packages should not be accepted from the courier without an official damage report, which must be sent back with the product.


If a return is approved by the Seller, all shipping fees will be refunded to the Buyer.


ARTICLE 8 – JURISDICTION


In disputes related to this agreement, the Consumer Arbitration Committees and Consumer Courts located in the Buyer’s or Seller’s jurisdiction, as announced by the Ministry of Trade, shall have authority.


By placing an order, the Buyer is deemed to have accepted all terms of this agreement.
